In a landmark decision for Nigeria’s oil and gas sector, the National Industrial Court of Nigeria (NICN) in Abuja has nullified the suspension of 15 staff members of the Nigerian Midstream and Downstream Petroleum Regulatory Authority (NMDPRA) by the Petroleum and Natural Gas Senior Staff Association of Nigeria (PENGASSAN). The ruling also dissolved the caretaker committee imposed on the NMDPRA branch, reinforcing constitutional compliance within the union.
Background: Suspension and Legal Challenge
In August 2025, PENGASSAN suspended 15 NMDPRA staff for 10 years, citing alleged misconduct, constitutional breaches, and actions prejudicial to the union. Dissatisfied with the decision, the affected staff approached the NICN, challenging both the suspension and the caretaker committee set up by PENGASSAN’s Central Working Committee (CWC).
The claimants argued that the caretaker committee’s installation was undemocratic, unconstitutional, and violated the PENGASSAN Constitution, which mandates branch elections within three months of a tenure’s expiration.
Court Finds Suspension Unlawful
Justice O.Y. Anuwe ruled that there was no evidence showing that the suspension was ratified by PENGASSAN’s National Executive Council (NEC). The court found that the Ethical, Grievance and Disciplinary Committee (EGDC), which recommended the suspensions, was improperly constituted, violating Rule 32.7 of PENGASSAN’s constitution.
“From the facts contained in the counter-affidavit of the defendants, the suspension of the claimants by the CWC was not ratified by the NEC before or after it was effected,” the court stated. “The claimants were therefore denied a fair hearing by a competent EGDC, making the disciplinary action unlawful.”
Reliefs Granted by the Court
Out of the 18 reliefs sought by the claimants, the court granted 12, including directives for PENGASSAN to:
- Commence branch elections within seven days in line with constitutional guidelines.
- Recognise that caretaker committees cannot govern beyond the three-month limit.
- Declare the 10-year suspension of the staff null and void.
Six reliefs, including additional punitive measures, were refused.
